1. At the initiative of the creditor or a person acting on his behalf and (or) in his interests, interaction with the debtor aimed at returning the overdue debt in the ways provided for in paragraph 1 of part 1 of Article 4 of this Federal Law is not allowed (direct interaction):

1) from the day the application for declaring a citizen bankrupt is recognized as justified and the restructuring of his debts is introduced or the debtor is declared bankrupt;

2) with the debtor from the moment of receipt of documents confirming the existence of grounds indicating that he:

a) is a person deprived of legal capacity, limited in legal capacity, including on the grounds provided for in paragraph 1 of Article 30 of the Civil Code of the Russian Federation;

c) is a disabled person of the first group;

d) is a minor (except for an emancipated person).

c) more than sixteen times a month.

6. In telegraph messages, text, voice and other messages transmitted over telecommunication networks, including mobile radiotelephone communications, in order to return an overdue debt, the debtor must be informed:

1) last name, first name and patronymic (if any) or the name of the creditor, as well as the person acting on his behalf and (or) in his interests;

2) information about the existence of overdue debt (without indicating its size and structure);

3) contact telephone number of the creditor, as well as the person acting on his behalf and (or) in his interests.

7. In all messages sent to the debtor by the creditor or a person acting on his behalf and (or) in his interests, for the purpose of returning overdue debt by mail at the place of residence or place of stay of the debtor, the following must be indicated:

1) information about the creditor, as well as the person acting on his behalf and (or) in his interests:

a) name, main state registration number, taxpayer identification number, location (for a legal entity), last name, first name and patronymic (if any) (for an individual), main state registration number (for an individual entrepreneur);

b) postal address, email address and contact telephone number;

c) information about contracts and other documents confirming the powers of the creditor, as well as the person acting on his behalf and (or) in his interests;

2) last name, first name and patronymic (if any) and position of the person who signed the message;

3) information about contracts and other documents that are the basis for the emergence of a right of claim against the debtor;

4) information on the amount and structure of overdue debt, the timing and procedure for its repayment (if the rights of claim of the previous creditor in part have been transferred to the new creditor, the amount of the rights of claim transferred to the creditor shall be indicated);

5) bank account details to which funds can be credited to repay overdue debts.

8. All text in messages sent to the debtor by mail and in documents attached to them must be displayed in a clear, easily readable font.

9. The creditor or a person acting on his behalf and (or) in his interests, for direct interaction with the debtor through telephone conversations, is allowed to use only subscriber numbers allocated on the basis of an agreement concluded between the creditor or a person acting on his behalf and (or) in his interests, and the telecom operator of the contract for the provision of telephone services. At the same time, it is prohibited to hide information about the contact telephone number from which a call is made or a message is sent to the debtor, or about the email address from which the message is sent, or about the sender of the email.

10. Interaction with the debtor must be carried out in Russian or in the language in which the agreement or other document on the basis of which the overdue debt arose was drawn up.

11. The provisions provided for in paragraphs 2 and 3 of part 3 of this article, establishing restrictions on the frequency of interaction with the debtor, are applied by the creditor or a person acting on his behalf and (or) in his interests, in relation to each independent obligation of the debtor.

12. The provisions provided for in paragraph 2 of part 5 of this article, establishing restrictions on the frequency of interaction with the debtor, are applied by the creditor or a person acting on his behalf and (or) in his interests in relation to each independent obligation of the debtor.

13. The debtor and the creditor have the right, including during negotiations on the restructuring of overdue debt, to enter into an agreement providing for the frequency of interaction with the debtor at the initiative of the creditor or a person acting on his behalf and (or) in his interests, different from that provided for in parts 3 and 5 of this article. Parts 2 - 4 of Article 4 of this Federal Law apply to the procedure for concluding an agreement and refusing it. The terms of such an agreement cannot diminish the human dignity of the debtor.
