Everything is very simple and clear. After completing one of the actions, all restrictions will be lifted, and the client will no longer be charged for using the option.

Why technical difficulties of VimpelCom should not infringe on the rights of its counterparties

As a result, the FAS rejected VimpelCom’s arguments. The department decided that the use of transliteration is not the same as the use of a foreign language, and the use of replacing Cyrillic characters with Latin ones preserves the phonetic sound of Russian words. Accordingly, clients are not required to actually know any foreign language, and messages in Latin do not distort clients' understanding of the information received.

The presence of any technical problems at VimpelCom, including with the specifics of the platform settings, should not infringe on the rights of its counterparties to conduct their activities in accordance with the specifics of their business and the terms of the concluded contracts. These circumstances should encourage VimpelCom to make changes to its technological process, and not be a reason for imposing favorable conditions on its counterparties, the FAS decided.

As subscribers of the Beeline corporate tariff (OJSC VimpelCom), we regularly review the monthly tariffs for cellular communication services. At the beginning of 2011, an invoice for SMS services SMS/RBT_CPA and premium rate mo sms in the amount of over 5 thousand rubles to one of our numbers attracted our attention. The Beeline support service reported that this number was subscribed to paid services on the Internet and the fee was collected by a third-party company.

Separately, I will explain that owners of legal numbers, in order to connect or disconnect any services, must write an official letter with the signatures and seals of the legal entity. faces. But in this case, it turned out that it was enough to go to the left site.

After a long correspondence with Beeline, we were returned the ENTIRE amount, but in two parts. One part was translated directly by Beeline, the second by the left office. (By the way, Beeline does not participate in these paid services).

In the letter for recalculation and refund, we asked to disable all paid services for our employees and to take this situation into account when issuing subsequent invoices.

After a couple of months, we stopped looking carefully at the sms services section because... After returning the money, we were fully confident that the service was blocked and a similar situation would not happen again. Large amounts were not billed.

Last month, we again noticed a large amount (about 2 thousand rubles) for an SMS from one of our numbers. After carefully reviewing the entire account, it turned out that paid messages (premium rate mo sms from the number 9637838916 and SMS/RBT_CPA from the numbers 9637839101, 9637839103, 9637839103, 963-783-91-06 .. etc.) also come to some of our other numbers , but to a lesser extent. After interviewing our employees, it turned out that they did not sign up for any paid subscriptions (consciously). Having checked the accounts for the previous months, we saw that several paid incoming messages (from 8 to 250 rubles per message) occur every month. The total amount of overpayment for the last 6 months was about 10 thousand rubles. And this is in a relatively small company (less than 50 rooms). Now there will be another lengthy correspondence and, possibly, litigation.
