What is the document for?

A power of attorney is a legally binding document that is created when it is necessary to represent the interests of a legal entity or individual. (Article 185 of the Civil Code of the Russian Federation). Megafon's power of attorney can be simple and general. How are they different, and when might this document be required?

A power of attorney in a simple form can be drawn up by hand or printed on a printer. A document should be certified by a notary only if the situation requires it. Such circumstances are provided for by the legislation of the Russian Federation and are specified in clause 3 of Art. 185 of the Civil Code of the Russian Federation (read more about which powers of attorney require mandatory notarization here).

If a simple power of attorney is issued to a person, the range of actions of the attorney within the framework of this document will be limited . In addition, the trustee will be required to notify the principal of each of his actions related to the power of attorney.

Like a general power of attorney, a simple form of power of attorney must be certified. Let's give a simple example. When a person is undergoing treatment in a hospital and needs to pick up or exchange a SIM card, he has the right to draw up a power of attorney, which will be certified by the chief physician of the hospital. Or, if a citizen represents the interests of an enterprise, then certification of the document should take place in the personnel department.

With a general power of attorney, everything happens differently. Such a document must be certified by a notary. In addition, the representative of the principal’s interests is vested with a wide range of powers and is no longer obliged to inform him of each of his actions related to the power of attorney.

Note! According to paragraph 2 of Art. 188 of the Civil Code of the Russian Federation, the principal can revoke the power of attorney at any time, just as the attorney can refuse it.

Types of powers of attorney

Any certificate provides for a formal transfer of rights to another party, while the principal retains legal status over the object. There are several types of powers of attorney, where you can fill out a ready-made form, substituting your parameters.

1. One-time agreement. The principal instructs the contractor to perform a one-time task or within a strictly defined period, for example, within one day. Most often, a one-time authority is used for a one-time operation of signing a document on behalf of the owner of the subscriber number.
2. Special agreement. The principal instructs the contractor to perform operations of the same type. In this case, the name of the operation is indicated, as well as the deadline for completing the specified instructions in the sample certificate.
3. General permission. The sample Power of Attorney provides for the performance of any operations with the subscription agreement without restrictions. The period for performing such operations is established in the permit. If the period is not specified, then by default such a certificate is valid for 12 months.

Which one to choose: simple or general?

Now let's give specific examples. At Megafon, if you have a power of attorney, you can perform the following actions:

• draw up and sign applications for refusal to use the subscriber number, as well as additional services provided with it;
• block the number;
• terminate the contract with the operator or restore service to subscriber numbers;
• replace the SIM card;
• receive from the value of a commodity-material nature;
• change tariff plan;
• refuse services or connect new ones;
• provide Megafon with the amended company data required to draw up the contract;
• receive an invoice for payment;
• request account details by written application;
• renew or terminate existing contracts with Megafon.

Important! The general power of attorney applies to all actions listed above.
Downtime may include all of the above powers or some of them. It all depends on the purpose for which the document was drawn up.

Duration and cost of the procedure

If the SIM card is replaced at the Megafon office, a duplicate can be issued on the same day. The old SIM card should not be disconnected from the network for more than 6 months and have an outdated tariff. In other cases, production takes up to 3 days. If the subscriber is not able to personally pick up the finished card, courier delivery services are available. The cost of courier work varies. A power of attorney to Megafon should be executed exclusively on company letterhead indicating the TIN.

According to Art. 186 of the Civil Code of the Russian Federation, if the document does not contain the date of its commission, then it will be invalid.

Remember that the document should include the following data (Articles 185 – 186 of the Civil Code of the Russian Federation):

1. Document's name.
2. Indication of the place where it was committed (city, region or village in its entirety).
3. If the document is not certified by a notary office, it should still indicate the address of the certificate.

• name of the document, place and date of registration of the certificate;
• personal information of the verifier, including the number of the current agreement with MGTS;

How to write from an individual?

A power of attorney from an individual must contain the following information:

• the date when the power of attorney was drawn up (clause 1 of Article 186 of the Civil Code);
• information of the person on whose behalf the actions will be performed - full name, passport details, date of birth (clause 1 of Article 185 of the Civil Code);
• information about the representative, as well as a list of actions that he can perform within the framework of the power of attorney (clause 1 of Article 185 of the Civil Code);
• period of validity of the document;
• signature of the person who issued the power of attorney.

Basic design rules

A power of attorney is first and foremost a document. It can be typed on a computer or written by hand. The exception is documents for which, for example, it is necessary to obtain material assets.

For such cases, unified forms have been developed. The power of attorney must also contain the following mandatory components:

1. The date on which the power of attorney was drawn up. Without it, it will be impossible to determine whether the document is currently valid or not.
2. Information about the representative and the principal. Remember that lack of information or its absence is not a reason to invalidate a document.
3. Signature of the principal. Without it, the document will not have legal force.

The power of attorney may also contain other information:

• validity;
• given to the representative.
